1. Who this agreement is with

Whizink ("Whizink," "we," "us") is operated by an individual based in India. These Terms & Conditions ("Terms") are a binding agreement between you and Whizink governing your access to and use of whizink.in and the Whizink app (together, the "Service"). By creating an account or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Service.

2. Who can use Whizink

Whizink is built for teenagers. You must be at least 13 and no older than 19 years old to create an account. By signing up you confirm that the birthdate you provide is accurate and that you fall within this range.

Because most Whizink users are minors under the law of their own country, we ask that a parent or guardian be aware their teen is using the Service, and we encourage parents to review these Terms and our Privacy Policy together with their teen. If you are a parent or guardian and want a Whizink account reviewed, restricted, or deleted, contact us using the details in Section 15 and we will act promptly.

You may not create an account on behalf of someone else, misrepresent your age, or use the Service if you've been previously suspended or removed, unless we've given you written permission to rejoin.

3. Your account

You're responsible for the security of your password and everything that happens under your account. Tell us immediately at the contact below if you think your account has been compromised. We may suspend or terminate accounts that violate these Terms or our Community Guidelines, at our discretion, following the enforcement process described in Section 6.

4. Your content

You keep ownership of everything you post — profiles, posts, comments, projects, achievements, images, and anything else you upload ("Your Content"). We don't claim ownership of it.

By posting Your Content, you grant Whizink a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, and distribute it solely for the purpose of operating and promoting the Service (for example, showing your post to your followers, or including a screenshot of the app in marketing materials). This license ends when you delete Your Content or your account, except for copies already made for backups, legal compliance, or content you shared with other users that they retain independently (like a comment on someone else's post).

You're responsible for Your Content and confirm you have the rights to post it. Don't post anything that infringes someone else's copyright, trademark, privacy, or other rights.

5. Acceptable use

Using Whizink means following our Community Guidelines, which are part of these Terms. In short: be honest about what you build, don't harass or endanger anyone, don't post sexual content involving minors or anyone else, don't share others' private contact information, and don't fabricate achievements or credentials.

Beyond the Guidelines, you agree not to:

  • Use the Service to break any law, or to infringe anyone's intellectual property or privacy rights.
  • Scrape, crawl, or use automated tools to collect data from the Service beyond what our public sitemap and robots.txt allow.
  • Attempt to gain unauthorized access to any account, system, or network connected to Whizink, or interfere with the Service's operation (including rate-limit evasion or denial-of-service attempts).
  • Impersonate any person or organization, or misrepresent your affiliation with one.
  • Use the Service for advertising, spam, or any commercial purpose we haven't authorized.
  • Reverse-engineer, decompile, or attempt to extract the source code of the Service, except where the law gives you that right despite this restriction.

6. Enforcement

Whizink is staffed by volunteer moderators organized in a hierarchy (Owner, Senior Moderators, Moderators) who review reports and take action — warnings, content removal, account restriction, or suspension — against accounts that violate these Terms or the Community Guidelines. Reports involving a staff member are handled by someone who outranks them, and the Owner's decisions on a case are final.

We try to be proportionate and fair, but moderation decisions on a platform like this are ultimately judgment calls, and we reserve the right to remove content or restrict accounts we reasonably believe violate these Terms, without prior notice where the situation warrants it (for example, content that endangers a minor).

7. Organizations, projects, and events

Whizink lets you create organizations, projects, and events that other users can be added to with a role. If you create one, you're responsible for the accuracy of what you post about it and for managing who has access. Removing yourself or being removed from an organization doesn't delete content other members posted independently. A project or organization you manage can be marked as recruiting, letting other users send a join request — accepting one adds that user with the default role; declining or ignoring it does nothing further.

8. Opportunities

You can submit hackathons, competitions, internships, scholarships, and similar opportunities for other users to discover. You're responsible for the accuracy of what you submit — Whizink is not the organizer of any opportunity listed here unless explicitly stated, and doesn't guarantee eligibility, outcomes, or that a listing stays accurate after submission. Submissions are reviewed before becoming visible to other users; we may reject or remove a listing at our discretion, including for spam, scams, or inaccurate information.

8. Intellectual property

The Whizink name, logo, and the Service's design, code, and branding (excluding Your Content) belong to Whizink. You don't get any rights to them beyond what's needed to use the Service normally.

9. Third-party services

We use third-party providers to run Whizink — for database hosting, file storage, email delivery, and application hosting. Details on what data they process are in our Privacy Policy. We're not responsible for those providers' own services beyond what they perform for us.

10. Termination

You can delete your account at any time from Settings. We may suspend or terminate your access if you violate these Terms, the Community Guidelines, or applicable law, or if we discontinue the Service. Sections that by their nature should survive termination — ownership, disclaimers, liability limits, and governing law — continue to apply after your account is closed.

11. Disclaimers

Whizink is provided "as is" and "as available." We're a small, actively-developed project and don't guarantee the Service will be uninterrupted, error-free, or permanently available. We don't verify the accuracy of what users post — achievements, project claims, or organization affiliations are self-reported and reviewed only through our moderation and reporting system, not independently confirmed by us.

12. Limitation of liability

To the maximum extent permitted by law, Whizink and its operator aren't liable for indirect, incidental, special, or consequential damages arising from your use of the Service, or for content posted by other users. Our total liability for any claim relating to the Service is limited to the amount (if any) you paid us in the 12 months before the claim arose.

13. Changes to the Service or these Terms

We may update these Terms as Whizink grows — we'll change the "Last updated" date above and, for changes that materially affect your rights, make a reasonable effort to notify you (for example, via email or an in-app notice) before they take effect. Continuing to use Whizink after a change takes effect means you accept the updated Terms.

14. Governing law

These Terms are governed by the laws of India, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Service will be subject to the exclusive jurisdiction of the courts of India. If you're using Whizink from outside India, local consumer-protection laws that can't be waived by contract still apply to you where required.
